These Terms of Service (“Terms”) govern your use of usagazebos.shop (the “Site”) operated by usagazebos (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.

Use of the site

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site.

Products and pricing

We attempt to be as accurate as possible in describing our products, including edition, specification, dimensions and condition. We do not warrant that product descriptions or other content on the Site are error-free. In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel any orders placed for that product and will notify you if this occurs.

All prices are listed in US dollars and are subject to change without notice. Unless a listing states otherwise, the price includes freight delivery to the lower 48 United States, usually within 5 to 7 business days.

New, refurbished and built-to-order items

Current production machines and boards are supplied new from the manufacturer or an authorised distributor. Older machines are genuine units of their era, inspected and refurbished before dispatch; cosmetic wear consistent with age is normal and is described in the listing. Items built or configured to your specification, including colourways and reserved production slots, are confirmed with you in writing before payment and are subject to the built-to-order terms in our Refund & Return Policy.

Orders and payment

When you place an order through the Site, you are making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

No payment is taken at the moment you place an order. Payment is taken at checkout when you place the order. We then confirm availability with the warehouse and email you the build details before anything ships. Your order is only accepted once that payment clears. Payment card details are entered on the payment provider’s own secure page and are never stored on this website.

Delivery and risk

Delivery terms, appointment booking and inspection obligations are set out in our Shipping Policy, which forms part of these Terms. You are responsible for confirming that a machine or board can physically be delivered to and installed at your address before ordering.

Intellectual property

All content on this Site, including text, graphics, logos, and images, is the property of usagazebos or its content suppliers and is protected by applicable intellectual property laws. Product names, logos, and brands referenced on this Site are the property of their respective trademark holders and are used for identification purposes only. usagazebos is not affiliated with, endorsed by, or sponsored by these brands unless explicitly stated.

Limitation of liability

To the fullest extent permitted by law, usagazebos will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products, including any damage arising from installation, modification or use of a machine or board after delivery.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Changes to these terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
